The Housing Choice Voucher (HCV) program — commonly called Section 8 — is the federal government's primary rental assistance program, administered by over 2,400 Public Housing Agencies (PHAs) nationwide. Landlords receive guaranteed monthly payments directly from the PHA for a tenant-selected portion of the rent. However, landlord participation rules vary significantly by state: in 17 states (plus localities in 7 more), refusing to rent to a voucher holder is a civil rights violation. In the remaining states, landlord participation is voluntary.

How Section 8 / HCV Payments Work for Landlords

Under the HCV program, a tenant finds a private-market unit and the PHA pays the landlord directly for the "voucher portion" of rent — the gap between 30% of the household's adjusted monthly income and the PHA's payment standard (based on Fair Market Rent). The tenant pays their share directly to the landlord. Payments are typically disbursed on the first of each month via ACH or check from the local PHA.

To participate, a landlord must sign a Housing Assistance Payment (HAP) contract with the PHA and allow a Housing Quality Standards (HQS) inspection of the unit before occupancy and annually thereafter. Rent must be within the PHA's payment standard and must be "reasonable" compared to unassisted market rents for comparable units.

HUD Housing Quality Standards (HQS) — What Inspectors Check

Every unit must pass an HQS inspection before a voucher holder can move in. Key standards include: functioning smoke detectors on every level, no lead paint hazards (pre-1978 units), working heating and cooling, no broken windows or doors, functioning plumbing and electrical, no evidence of pest infestation, and adequate space (minimum one bedroom per two occupants). Annual re-inspections apply while the HAP contract is active. Failed inspections delay payment until deficiencies are corrected.
